1. Acceptance of Terms
Welcome to Xordinari Golf. These Terms of Service (“Terms”) govern your access to and use of the Xordinari Golf mobile application, website, and related services (collectively, the “Service”), operated by Xordinari Golf LLC (“we,” “us,” or “our”).
By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not access or use the Service.
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
2. Description of Service
Xordinari Golf is a golf software platform that provides, among other features:
- Golf round tracking, scoring, and hole-by-hole stat recording
- Handicap index calculation following World Handicap System (WHS) guidelines for recreational use (not an official GHIN handicap)
- League and tournament management tools for organizers and players
- An optional AI caddie feature that generates personalized coaching insights from your round statistics
Specific features available to you depend on your subscription tier. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. User Accounts
To access most features you must register for an account. You must be at least 13 years of age. By creating an account you represent that you meet this requirement.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Promptly notifying us at legal@xordinari.com of any unauthorized access or security breach
Each person may hold only one account. Creating multiple accounts to circumvent restrictions, manipulate handicaps, or abuse any feature is a material breach of these Terms.
4. Subscription and Billing
Free tier — Xordinari Golf offers a free tier that is free forever, not a time-limited trial. No credit card is required. Core scoring, basic stats, and participation as a player in leagues are always available at no charge.
Plus and Pro tiers — Additional features are unlocked on paid subscription tiers. Current pricing is displayed in the app and on our pricing page at the time of purchase.
In-app purchases — Subscriptions purchased through the Xordinari Golf iOS or Android app are processed and managed by Apple (App Store) or Google (Google Play), respectively, subject to their terms and billing policies.
- Subscriptions renew automatically at the end of each billing period until you cancel
- You may cancel at any time through your device's App Store or Google Play subscription settings; access continues through the end of the current billing period
- No refunds are issued for partial subscription periods remaining after cancellation, or for any subscription period that has already been charged and delivered
- We reserve the right to change subscription pricing with advance notice; price changes take effect at your next renewal
5. Acceptable Use
You agree not to:
- Submit false, fraudulent, or intentionally incorrect scores to manipulate handicap indexes, standings, side-game results, or any other competitive outcome
- Scrape, crawl, spider, or systematically harvest any data from the Service without our prior written permission
- Impersonate another person, organization, or entity
- Use the league chat or any communication feature to harass, threaten, defame, or abuse other users
- Reverse engineer, decompile, or attempt to extract source code from the app
- Upload or transmit viruses, malware, or any other harmful or disruptive code
- Use the Service for any unlawful purpose or in violation of applicable law
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
We reserve the right to suspend or permanently terminate accounts that violate these prohibitions, without refund, and to report unlawful conduct to appropriate authorities.
6. User Content
“User Content” means any data, scores, statistics, photos, comments, or other information you submit to or through the Service.
You own your data. You retain full ownership of your User Content. We do not claim ownership of your golf history, round records, or any other data you create.
License to us. By submitting User Content to the Service, you grant Xordinari Golf LLC a limited, non-exclusive, royalty-free, worldwide license to store, process, and display your User Content solely for the purpose of providing the Service to you and, where applicable, to other users in the same league or event (for example, displaying scores on a shared leaderboard). This license terminates when you delete the content or close your account.
We will not sell your data. We do not sell your User Content or personal information to third parties for advertising or marketing purposes. See our Privacy Policy for full details on how we handle your data.
You represent and warrant that you have all rights necessary to submit your User Content and that doing so does not violate any third-party rights.
7. AI Features
Xordinari Golf offers optional AI-powered features including the AI Caddie, pre-round briefings, post-round debriefs, and scorecard photo analysis, powered by Anthropic’s Claude AI API. Use of any AI feature is entirely voluntary and can be enabled or disabled at any time in your app settings.
Provided “as-is” without warranty of accuracy. AI features are provided on an “as-is” basis without any warranty, express or implied, as to the accuracy, completeness, or fitness of the output for any particular purpose. AI-generated content is for informational and entertainment purposes only and is not a substitute for instruction from a qualified PGA professional or certified golf instructor.
Not for rules decisions. Do not rely on the AI Caddie or any AI-generated content to resolve rules disputes or make official rules determinations. For authoritative rules guidance, consult the official Rules of Golf published by the USGA and The R&A.
Data transmitted. When you use AI features, relevant golf data (scores, stats, course context, and where applicable scorecard photos) is transmitted to Anthropic’s API servers for processing. Your name, email address, payment information, and other personally identifiable information are never included in this transmission. Modification or removal. We reserve the right to modify, limit, or discontinue any AI feature at any time, including to manage costs associated with third-party AI providers, without prior notice. Removal of an AI feature does not entitle you to a refund of any subscription fees already paid.
8. Intellectual Property
The Xordinari Golf app, website, logo, brand name, and all platform content that is not User Content — including but not limited to software, design, copy, graphics, and data models — are the exclusive property of Xordinari Golf LLC and are protected by copyright, trademark, trade secret, and other applicable intellectual property laws.
These Terms do not grant you any right to use our name, logo, trademarks, or other brand assets without prior written consent. All rights not expressly granted herein are reserved by Xordinari Golf LLC.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities. We do not warrant that defects will be corrected or that the Service is free of viruses or other harmful components.
Handicap disclaimer. The handicap index calculated by Xordinari Golf follows WHS guidelines and is intended for recreational use within our platform. It is not an official USGA/GHIN handicap index. For formal competition or official handicap purposes, use the USGA's official system through an authorized golf association.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XORDINARI GOLF LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such jurisdictions the above limitations apply to the fullest extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Xordinari Golf LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of or inability to use the Service
- Your violation of these Terms
- Your User Content
- Your violation of any third-party right, including any intellectual property, privacy, or contractual right
We reserve the right to assume exclusive control of any matter subject to indemnification, in which case you agree to cooperate with our defense of that claim.
12. Termination
By you. You may close your account at any time from Account Settings within the app. Upon account deletion, your personal data will be purged within 30 days in accordance with our Privacy Policy. Paid subscription periods that have already been charged will not be refunded.
By us. We may suspend or permanently terminate your access to the Service, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or abusive conduct, or if continued provision of the Service to you would expose us or others to legal or reputational risk.
Upon termination, all rights and licenses granted to you under these Terms will immediately terminate. Sections that by their nature should survive termination (including User Content, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
13. Governing Law
These Terms and any dispute arising from or related to them or the Service are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in a court of competent jurisdiction located in Colorado, and you hereby consent to personal jurisdiction and venue in such courts.
